2 Processing of your personal data and purposes of processing

2.1 When visiting the website

You can visit our website without having to disclose your identity. The browser used on your device only automatically sends information to the server of our website (e.g. browser type and version, date and time of access) to enable the website to establish a connection. This also includes the IP address of your requesting device. This is temporarily stored in a log file and deleted after 90 days.

The IP address is processed for technical and administrative purposes of connection establishment and stability in order to ensure the security and functionality of our website and to be able to prosecute any illegal attacks on it if necessary.

The legal basis for the processing of the IP address is Art. 6 para. 1 sentence 1 lit. f GDPR. Our legitimate interest follows from the aforementioned security interest and the need to provide our website without disruption.

We cannot draw any direct conclusions about your identity from the processing of the IP address and other information in the log file.

We also use cookies when you visit our website. You will find more detailed explanations in this data protection information below.

2.2 Processing of responses when participating in the survey

Participation in the survey is voluntary. All information will be treated confidentially.

The purpose of the survey is to ensure that our research has a high practical and industry-oriented relevance. In this way, we want to fulfill our social mandate as the Fraunhofer-Gesellschaft. To this end, we would like to use this survey to find out for which fields of application our technology is particularly relevant and what changes are necessary to make it even more widely applicable.

As such questions are very often application- and user-specific, we ask you in our survey whether we may contact you for further surveys and discussions. You can answer this question at your own discretion and interest. If you answer this question in the affirmative, we will ask you for your contact details (processing of responses with contact information). If you do not answer this question in the affirmative, your answers will be analyzed anonymously (processing of answers without providing contact information). The contact details can therefore be provided voluntarily and are not necessary in order to participate in the survey. Further information can be found in the following sections.

a) Processing of responses without providing contact information

Legal basis and processing purposes

If it is possible to draw conclusions about the person of the participant through the choice or formulation of the answers, the data processing is carried out to safeguard our legitimate interests in accordance with Art. 6 para. 1 sentence 1 lit. f GDPR. It serves to research the user-independent relevance of our technologies for various use cases. This constitutes legitimate interests within the meaning of the aforementioned provision.

We store the survey questions and answers for 3 years after the survey. In addition, the results are evaluated and analyzed by Fraunhofer employees.

The survey is evaluated in its entirety. This means that questions for which less than two (2) answers were received will also be analyzed. Your answers will be aggregated and analyzed by us. Due to the nature of the evaluation and the objective of the survey, it may not be possible to conduct a completely anonymous survey. At the very least, it cannot be ruled out that the combination of the responses with other information may make it possible for the project staff to identify you personally. By participating in the survey, you consent to your data being processed as part of the evaluation and to the results of the evaluation being used to ensure the high industrial relevance of our research.

The documentation and possible publication of the survey results will be carried out in anonymized form exclusively, without mentioning your name and without providing information that would allow conclusions to be drawn about your person.

b) Processing of responses with contact information

Personal data:

The following personal data is processed as part of the survey:

- Name

- Title

- Salutation

- E-mail address

- Company affiliation

Categories of personal data

As part of the survey, participants have the opportunity to provide their name, title, company affiliation and e-mail address. On the one hand, this allows us to better interpret your information by providing better context. On the other hand, we use your contact details to get in touch with you if necessary. This allows us to ask you more detailed questions than would be possible with an online survey. As a result, we expect a more precise survey result. We use your name, title and e-mail address to contact you. Your company affiliation helps us to better assess the background of your answers.

The email address will only be stored for the duration of the research project, but for no longer than 3 years after the last contact. If the contact information is not provided, the survey will be analyzed anonymously (see 2.2.a). If the contact information is provided voluntarily to enable contact to be made, the survey cannot be evaluated anonymously for the survey participant.

Legal basis and processing purposes

We evaluate your participation in the survey in such a way that - as far as possible - we carry out an anonymized evaluation of your answers with a view to ensuring high industry relevance in the context of the development of 3D reconstruction and rendering technologies. We base the processing on our legitimate interest (Art. 6 para. 1 lit. f GDPR): The legitimate interest is to analyze your anonymized statements for research in the field of 3D reconstruction. We want to find out for which use cases our technology is particularly relevant and how it needs to be modified in order to be used as widely as possible. We assume that the evaluation of your responses for this purpose is also in your interest in order to fulfill our mission of research for industry and society.

The purpose of the processing is to aggregate as many opinions as possible into an overall picture, taking into account the relevant professional context of the answers given.

We store the survey questions and answers. In addition, the results are evaluated and analyzed by Fraunhofer employees.

The e-mail address will be deleted no later than 3 years after the last contact.

The documentation and any publication of the survey results will be carried out exclusively in anonymized form, without mentioning your name and without providing information that would allow conclusions to be drawn about your person.

Duration of storage of personal data

Your personal data will be deleted and the survey results anonymized no later than 3 years after the last contact.

As part of the online survey, we use LimeSurvey as a technical tool for conducting the survey. LimeSurvey is hosted by the Fraunhofer-Gesellschaft. For this purpose, the data entered is stored on the servers of the Fraunhofer-Gesellschaft in Germany.

3 Passing on the data

As a matter of principle, we do not pass on your data. Disclosure to third parties is only possible if:

- you have given your express consent to this in accordance with Art. 6 para. 1 sentence 1 lit. a GDPR;

- this is necessary for the performance of a contract with you pursuant to Art. 6 para. 1 sentence 1 lit. b GDPR or

- in the event that there is a legal obligation for the transfer pursuant to Art. 6 para. 1 sentence 1 lit. c GDPR.

The transfer of personal data to a third country (outside the EU) or an international organization is excluded.

4 Rights of data subjects

You have the right:

  • in accordance with Art. 7 para. 3 GDPR, to withdraw your consent once given to us at any time. As a result, we may no longer continue the data processing based on this consent in the future;
  • to request information about your personal data processed by us in accordance with Art. 15 GDPR. In particular, you can request information about the purposes of processing, the category of personal data, the categories of recipients to whom your data has been or will be disclosed, the planned storage period, the existence of a right to rectification, erasure, restriction of processing or objection, the existence of a right of appeal, the origin of your data if it was not collected by us, and the existence of automated decision-making including profiling and, if applicable, meaningful information on its details;

  • in accordance with Art. 17 GDPR, to request the erasure of your personal data stored by us, unless the processing is necessary for exercising the right of freedom of expression and information, for compliance with a legal obligation, for reasons of public interest or for the establishment, exercise or defense of legal claims
  • in accordance with Art. 18 GDPR, to demand the restriction of the processing of your personal data if the accuracy of the data is disputed by you, the processing is unlawful but you refuse to delete it and we no longer need the data, but you need it to assert, exercise or defend legal claims or you have lodged an objection to the processing in accordance with Art. 21 GDPR;
  • in accordance with Art. 20 GDPR, to receive your personal data that you have provided to us in a structured, commonly used and machine-readable format or to request its transmission to another controller; and
  • to lodge a complaint with a supervisory authority in accordance with Art. 77 GDPR. As a rule, you can contact the supervisory authority of your usual place of residence or workplace or our company headquarters.

Information about your right to object in accordance with Art. 21 GDPR

You have the right to object, on grounds relating to your particular situation, at any time to processing of personal data concerning you which is based on point (e) of Article 6(1) GDPR (data processing in the public interest) and point (f) of Article 6(1) GDPR (data processing on the basis of a balancing of interests); this also applies to profiling based on this provision in accordance with Article 4(4) GDPR.

If you object, we will no longer process your personal data unless we can demonstrate compelling legitimate grounds for the processing which override your interests, rights and freedoms, or the processing serves the establishment, exercise or defense of legal claims.

If you object to the processing of data for the purpose of direct marketing, we will cease processing immediately. In this case, it is not necessary to specify a particular situation. This also applies to profiling insofar as it is associated with such direct advertising.

If you wish to exercise your right to object, simply send an email to datenschutzkoordination@zv.fraunhofer.de.

5 Data security

All data transmitted by you personally will be encrypted using the generally accepted and secure TLS (Transport Layer Security) standard. TLS is a secure and proven standard that is also used in online banking, for example. You can recognize a secure TLS connection by the s appended to the http (i.e. https://..) in the address bar of your browser or by the lock symbol at the bottom of your browser.

We also use suitable technical and organizational security measures to protect your data against accidental or intentional manipulation, partial or complete loss, destruction or unauthorized access by third parties. Our security measures are continuously improved in line with technological developments.
